STATEMENT- To all whom it may co'/”lce1°n: Be it known that I, ITAROLD H. Firms, a citizen of the United States, residing at No. 40 “lest Fifty-ninth street, borough of Man- hattan, city, county, and State of New York, trading as Fnms & Bno., at No. 92 Reade street, in the borough of Manhattan, city, county, and State of New York, have adopt- ed for my use the trade-mark shown in the accompanying drawing, for a non-alcoholic beverage similar to soda-water and having f I a peach flavor, in Class No. 45, Beverages, non-alcoholic. The trade mark has been continuously used in 11157 business since J uly, 1908. The trade mark is used by applying printed labels bearing the mark to the recep- tacles containing the goods, or by stamping or branding the mark upon said receptacles, and otherwise. HAROLD H. FRIES. DECLARATION- State of New York county of New York ss: TIAROLD H. Fnins being duly sworn, de- poses and says, that he is the applicant named in the foregoing statement; that he believes the foregoing statement to be true; that he believes himself to be the owner of the trade-mark sought to be registered; that to the best of his knowledge and belief no other person, firm, corporation or associa- tion has the right to use said trade-mark, either in the identical form, or in any such near resemblance thereto as might be calcu- lated to deceive; that the description, draw- ing and specimens or fac-similes presented truly represent the trade-mark sought to be registered; that said trade-mark is used by applicant in commerce among the several States of the United States, and particularly between New York and North Carolina, South Carolina, Georgia.
